Unfortunately this US spammer was not jailed for spamming, as many of
us would have hoped. It's a hollow victory, IMO.

"Howard Carmack, known as the "Buffalo Spammer," received the maximum
sentence for 14 counts of identity theft and forgery ... Carmack sent
out hundreds of millions of bulk e-mail messages, flooding inboxes and
saddling Internet providers with millions of dollars in costs. But it
was his use of stolen identities and forged addresses that caused him
to run afoul of state prosecutors."

Unfortunately this US spammer was not jailed for spamming, as many of
us would have hoped. It's a hollow victory, IMO.
While I agree with you that they didn't actually get him for spamming
- at least they did get him for something - and that is a lot better
than getting him for nothing at all I guess.
Bit like Al Capone. As I recall he never got done for any of his
infamous crime activity - but they did at least get him for tax
avoidance :)

I'm slightly encouraged by the occasional story I've seen in the US
media, that the FBI's identified 100 of the most prolific spammers,
and is making plans to bust about 50 of them later this year. If it
happens (which I'm not holding my breath waiting for), that might make
the rest of these parasites sit up and take notice, and start
wondering just whose credit cards they're charging their scams to.

He setup 343 false accounts and addresses with Earthlink.
What spammer uses his real identity and email address?

Like Bob said, Elliot got big Al on a minor charge, however he spent the
rest of his short life in the clink.
Hardly a hollow victory.

Yes, that's the point Frank.
He setup 343 false accounts and addresses with Earthlink.
What spammer uses his real identity and email address?
Look at it another way. If he had spammed using his real name and his
real address, then he would have been convicted of nothing, unless
stupidity is a crime. In fact I see lots of Usenet spam from real
people and real businesses.

Funny, I thought the same thing. But it's all happening in the Good
'Ol US of A where "Commercial Free Speech" and The Free Enterprise
System takes priority over everything else, including the right of
internet users all over the planet to use e-mail without small-time US
criminals vandalizing the system and stealing their mailbox capacity
and other resources they've paid for.

Ya learn something almost every day. But even so, I've gotta say that
the last time I got any spam which was recognizably Australian was
about 3 years ago. Every day I get >400 spams which are obviously
American. Maybe it's only me.
