Man jailed 10 months for touching children for sexual purpos

A 46-year-old Fort Augustus man was sentenced Monday in P.E.I. Supreme
Court to serve 10 months in the provincial correctional centre for
having touched two children for sexual purposes.
The sentence was imposed in the case of Jean-Guy Joseph Martin. Upon his
release from custody Martin will spend three years on probation.
While on probation he must undergo assessment, counselling and treatment
for the use of alcohol and/or drugs and or any other underlying issue
that may have contributed to the commission of these offences.
Supreme Court Justice John Mitchell ordered Martin to have no contact
with the victims or their parents. Mitchell also ordered the accused to
provide a sample of his bodily fluids for the national DNA databank. He
must also register with the national sex offender registry.
Martin was found guilty at trial of touching the children for sexual
purposes on five separate occasions in two different locations.
His actions were directed at one child three times and at the other
child, twice.
Mitchell described these incidents of sexual interference as egregious,
saying they could leave huge emotional scars on the children involved,
scars their parents will hopefully be able to help them overcome.
Victim impact statements read by their parents, who were devastated by
what happened to their children, showed Martin’s actions had already
taken their toll on these young victims.
In passing sentence, Mitchell said the focus had to be placed on
denunciation and deterrence.
“No one is more vulnerable than our children,” Mitchell said.
The Crown had called for a sentence of 16-20 months. The defence had
proposed a sentence of 5-6 months.
With mandatory remission, Martin could be out of jail by Christmas.
The Martin trial was the first trial in P.E.I. to utilize closed circuit
television to allow the child victims of sexual offences to give
testimony without having to be in the same courtroom as the accused.
