SAN DIEGO, Calif. (CBS 8) - Parents in the East county are up in arms
after a convicted child molester moved in just blocks away from two
schools and a daycare. One mother contacted the News 8 CrimeFighters,
asking for help.
The offender is 42-year-old David Bruce McCall. Court records show he
was charged with 15 counts of committing a lewd act on a 12-year-old
girl in 2007. He pleaded guilty to one count, and was sentenced to a
year in jail.
Now he's out and living at his parents' house on Hunter Pass in Harbison
Canyon, less than 2,000 feet from a daycare center and two schools.
Neighbors are upset.
"I found out about it from my children's daycare and it was disturbing
to me because there's supposed to be a law in place that they're not
allowed to live within 2,000 feet of a daycare or school," parent
Candice Ray said.
Ray is talking about Jessica's Law, passed by California voters in 2006.
Because of court challenges, the San Diego Probation Department is not
enforcing the 2,000-foot residency restrictions under the law.
"I called the probation officer and many other people and we've all been
told nothing can be done. Jessica's Law is in litigation and there's
nothing they can do about it right now," Ray said.
McCall signed a document when he was sentenced saying he may be required
to live 2,000 feet away from any school. The probation department says
it only recently found out about the home daycare center down the
street, and an officer is reviewing McCall's living arrangement with his
parents.
There is no indication in his court file that McCall is a sexual
predator. Still, neighbors question the wisdom of letting a convicted
child molester live in close proximity to schools.
"You don't send an alcoholic to a bar and expect him not to take a
drink. In the same way, sexual offenders should not be in front of
children all day long," Ray said.
Late Thursday afternoon, the probation department issued a statement to
News 8 saying stable housing is a key component to supervising sex
offenders, and that McCall's housing situation is being reviewed in
light of recent citizen complaints.
